The Three Components of Law

Law

There are three components of law. They are its Formal elements, its Institutional character, and its effects on moral thought. Let us first consider the role of the law in society. Essentially, it acts as a mediator between people. It shapes society, politics, economics, and history. In the same way, it also shapes human relationships.

Rule of Law

Rule of law is a political philosophy that holds all institutions, individuals, and leaders to the same standards of accountability. This philosophy has been a staple in Western societies for centuries. In this system, all citizens, legislators, and leaders are held to the same standards of accountability and uphold the laws that govern their country.

The concept of the rule of law is ancient, and can be traced back to ancient Greece. It has become more prevalent in recent decades, though. According to former U.S. Supreme Court Justice Anthony M. Kennedy, the term “rule of law” did not exist when he attended law school in the 1950s.

Formal elements

In law, formal elements are features that define the quality of a law. These features may be content-oriented or source-oriented. They also may prevent substantive changes in law. For example, a law may be closed to more authoritative infusion of legal content at its point of application. This contrast is known as the form-substance distinction.

The content of law reveals how law is intended to function in society. It is infinitely variable and differs between different societies. It can be described by the social conditions of a society.

Institutional character

The institutional character of law is a key feature of the way law is made and applied. It is an important social phenomenon that should reflect the values, norms, and goals of society. In other words, it should be in accordance with the Volksgeist. That is to say, it should be able to justify and govern morality.

The legal consciousness of the twentieth century in Western Europe displayed a worrisome image. This legal consciousness was dominant from 1933 to 1945. The idea that law was a reality created to conform to the will of the people posed an uncomfortable challenge for de Haan. Political parties were seen as the representative of the people, and their actions shaped the nature of law and reality.

Effects on moral thought

Law is an institution that governs human behavior, including morality. Laws can be interpreted in a variety of ways. In addition to making certain actions morally unacceptable, laws can also help maintain social order and prevent violent crime. However, there are times when laws do not fully protect human rights. In these cases, it may be permissible to use force against a person who threatens to attack you or steals your food or water.

While most philosophers who discuss morality have little interest in law, legal theorists are more concerned with the descriptive and normative relationship between law and moral thought. For example, Hart distinguishes between morality and law by identifying “secondary” rules that empower officials and create institutions that apply primary rules.

Examples

A lawyer can provide a variety of services to his or her clients. Some of these services include financial planning, real estate counseling, and trust services. Others include economic analysis, legislative lobbying, and psychological counseling. Some lawyers also offer patent consulting. The services they provide can vary greatly, depending on their field. Some lawyers are a mix of different disciplines, so they will provide different services to clients.

A law is a body of rules and regulations enforced by a government authority. It is also a set of rules that citizens must abide by. If they do not, they can face fines or jail time. In some cases, a law can refer to a particular set of laws or the entire laws of an entire country. For example, saying that murder is against the law means that a person cannot commit murder in a certain geographic area.
